1. Scope of Service & Eligibility
1.1 Service Description: The Same-Day/Next-Day Express shipment service allows customers to place orders for select jewelry items online and receive delivery within 24–48-hour window, subject to order placement deadlines and system processing.
1.2 Regional Availability: This service is strictly restricted to selected pin codes within the Kolkata region. Gossip reserves the right to amend, expand, or restrict the list of eligible pin codes at any time without prior notice.
1.3 Eligibility Verification: Customers must verify service eligibility for their specific location by entering their delivery pin code on the Product Detail Page (PDP) prior to proceeding to final checkout. Delivery options displayed on the checkout page are subject to product availability, operation feasibility, and successful order confirmation by Gossip.
1.4 Product Availability: Availability of products under the Express Shipment service is subject to inventory availability at the designated fulfilment location. Gossip reserves the right to withdraw, substitute, or cancel any order where inventory is unavailable or insufficient to fulfil the order within the applicable delivery timeline.
1.5 Product Eligibility for Express Shipment: Not all products listed on the website may qualify for the Express Shipment Service. Eligibility depends on product category, inventory location, stock availability, operational feasibility, and serviceability of the delivery address. Availability of Express Shipment shall be displayed at checkout and shall remain subject to final confirmation by Gossip.
1.6 Service Availability Errors: In the event the website, mobile application, inventory system, or any technical platform erroneously displays Express Shipment availability due to technical, inventory, mapping, operational, or system errors, Gossip reserves the right to revise the delivery timeline, convert the order to standard delivery, or cancel the order and process a refund in accordance with applicable policies.
1.7 Right to Refuse Service: Gossip reserves the right to refuse, suspend, restrict, or cancel Express Shipment service for any customer, order, address, locality, or pin code where fraud risk, security concerns, operational limitations, regulatory requirements, or business considerations make fulfilment impracticable or undesirable. 2.Financial Terms & Pricing
2.1 Service Fees: Currently, Gossip provides this Express Shipment mode (Same-Day/One-Day) at no additional premium or delivery charge to the customer. Gossip reserves the right to introduce a delivery fee structure for this premium service in the future.
2.2 Payment & Transaction Clearance: All express fulfillment timelines are strictly conditional upon the receipt of immediate payment clearance from our authorized banking and payment gateway partners. Shipment timelines shall commence only upon successful payment authorization, transaction confirmation, and fraud screening clearance, where applicable.
2.3 No Guaranteed Delivery Commitment: Shipment timelines displayed on the website or communicated to customers are indicative estimates only and shall not constitute a guaranteed delivery commitment. Actual TAT may vary due to operational, logistical, technical, regulatory, or other unforeseen circumstances beyond Gossip’s reasonable control.
2.4 Time not of the essence: Time shall not be deemed to be of the essence in relation to delivery timelines communicated under the Express Shipment Service. Any dispatch timelines displayed or communicated are estimates only and delays in delivery shall not constitute a breach of contract or entitle the customer to compensation, damages, cancellation, or refund except as required under applicable law. 3.Delivery Protocols & Security
3.1 Security & Fraud Prevention: To safeguard buyers and eliminate fraudulent transactions, all express shipments are strictly Secure OTP (One-Time Password) based. The package will only be released by the courier partner upon successful validation of the OTP provided to the customer's registered mobile number/email address at the time of delivery. The customer shall solely be responsible for maintaining the confidentiality of the OTP and shall not share the OTP with any unauthorized person. Delivery completed upon successful OTP verification shall be deemed valid delivery. The Customer acknowledges that disclosure of the OTP to any person shall be deemed authorization by the customer for delivery of the order. Gossip and Senco Gold Limited shall not be liable for any loss, theft, mis delivery, or claim arising from unauthorized disclosure, sharing, misuse, compromise, or negligent handling of the OTP by the customer or any third party acting on the customer’s behalf.
3.2 Courier Delivery Policy: In instances where the customer is unavailable, unreachable, or rejects the delivery at the designated address, the third-party logistics/courier partner will handle the consignment in accordance with their standard operating mechanism and corporate delivery retry policy.
3.3 Additional Verification: For security, fraud prevention, regulatory compliance, or operational reasons, Gossip reserves the right to undertake additional customer verification measures including identity verification, address verification, telephonic confirmation, KYC verification, or such other authentication procedures as it may deem necessary prior to dispatch or delivery.
3.4 Transfer of Risk: Risk in the products shall pass to the customer only upon successful delivery and OTP verification at the designated delivery address.
3.5 Failed Delivery Attempts: Where delivery cannot be completed due to customer unavailability, inability to establish contact with the customer, refusal to provide OTP, refusal to accept delivery, incorrect delivery details, or any customer- attributable reason, the order shall be dealt with in accordance with the Company’s prevailing delivery, cancellation, and refund policies.
3.6 Customer Responsibility for Address Details: The customer shall be solely responsible for providing complete, accurate, and up-to-date delivery information. Gossip shall not be liable for any delay, failed delivery, loss, or additional costs arising from incorrect, incomplete, or inaccurate information provided by the customer.
3.7 Delivery Records: The Company and/or its logistics partner may maintain electronic records including OTP logs, delivery acknowledgments, call records, photographs, GPS data, electronic proof of delivery, CCTV footage, and other operational records relating to the delivery. Such records may be relied upon as evidence of delivery and transaction fulfilment to the extent permitted under applicable law.
3.8 Inspection upon Delivery: Customers are advised to inspect the package at the time of delivery. Any claim regarding tampering, shortage, damage, or discrepancy in the delivered package must be reported to Gossip within 24 hours of delivery, together with supporting evidence, failure to report such issues within the aforesaid period may affect the customer’s ability to seek remedies in relation to such claims, subject to applicable law.
3.9 Open Delivery Restriction: Deliveries shall ordinarily be made in sealed conditions. Open-box-inspection or verification in the presence of delivery personnel may not be available and may be refused at the sole discretion of the Company or its logistics partners. 4.Limitation of Liability & Customer Obligations
4.1 Customer Non-Availability: Gossip shall not be held liable or responsible for any failure to meet the promised delivery timeline if: • The customer is absent or unavailable at the designated delivery address during the delivery attempt. • The consignment is routed to a designated pickup store at the customer's request or per delivery logistics, and the customer fails to pick up the package on the promised arrival date.
4.2 Limitation of Liability: To the maximum extent permitted under applicable law, neither Gossip nor Senco Gold Limited shall be liable for any indirect, incidental, consequential, special, exemplary, or punitive damage arising out of or relating to the Express Shipment Service. In any event, the aggregate liability of Gossip/Senco Gold Limited shall not exceed the amount paid by the customer for the relevant order.
4.3 Third Party Logistics Disclaimer: Express Shipment is facilitated through independent third-party logistics and courier service providers. Gossip and Senco Gold Limited shall use reasonable efforts to coordinate with third party logistics partners for timely delivery. However, delivery timelines may be affected by circumstances attributable to such logistics partners.
4.4 Force Majeure: Gossip shall not be liable for any delay, interruption, or failure in performance of the Express Shipment Service caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, floods, earthquakes, epidemics, pandemics, strikes, labour disputes, transportation disruptions, governmental restrictions, civil disturbances, technical failures, courier network disruptions, or other force majeure events. 5.Refund & Cancellations
5.1 Management Discretion: Any disputes, claims for service failures, or customer refund requests arising out of or related to the Express Shipment service shall be reviewed and determined by Senco Gold Limited in accordance with applicable law, internal policies, and the facts of each case.
5.2 Refund Timelines: Approved refunds will be processed exclusively back to the original source payment mode used during the transaction, in strict compliance with standard scheduled refund timelines and banking protocols.
5.3 Order Cancellation by Gossip: Gossip reserves the right to cancel any order prior to dispatch in cases including but not limited to product unavailability, suspected fraud, payment verification failure, pricing errors, technical issues, regulatory requirements, or any circumstance making fulfilment impracticable. In such cases, any amount received from the customer shall be refunded in accordance with applicable refund policies.
5.4. Returns, Exchanges and Buyback: The availability of Express Shipment shall not alter or affect the applicability of Gossip’s Return, Exchange, Buyback, Cancellation, Warranty, or Refund Policies. Such policies shall continue to apply independently in accordance with their respective terms and conditions. The Company’s Return, Refund, Cancellation, Exchange and Buyback Policies available on the website form an integral part of these Terms and Conditions. 6.Governing Law and jurisdiction
6.1. These Terms and Conditions shall be governed by and construed in accordance with the Laws of India.
6.2. Subject to applicable consumer protection laws and mandatory statutory rights available to consumers, any dispute arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts at Kolkata, West Bengal.
6.3 Gossip reserves the right to modify, amend, update, or discontinue the Express Shipment Service and/or these Terms and Conditions at any time without prior notice. The version of the Terms in force on the date of order placement shall apply to the relevant transaction.
6.4. Personal information collected for the purpose of processing and fulfilling Express Shipment orders shall be processed in accordance with the Company’s Privacy Policy and applicable data protection laws. By availing the Express Shipment Service, the customer authorizes the Company and its authorized service providers, logistics partners, and affiliates to process and share relevant delivery-related information strictly for order fulfilment, customer support, fraud prevention, verification, regulatory compliance, and related operational purposes. By placing an order through the website, the customer consents to receive communication relating to the order, delivery, OTP verification, service updates, refunds, and customer support through SMS, email, telephone, WhatsApp, push notifications, or other electronic means.
